The European Investment Law and Arbitration Review has published the 11th EFILA Annual Lecture delivered by Prof. Maxi Scherer on 'Artificial Intelligence (AI) in Investment Arbitration'. The lecture was delivered on 27 November 2025 at the Queen Mary University of London.
The lecture addressed the potential and challenges of AI in the specific context of investment arbitration. It noted that predictive AI may be particularly well-suited to investment arbitration due to availability of a large dataset and the existence of repetitive issues which are often binary in nature, though the risk of hallucinations may be higher for similar reasons. The lecture then highlighted the absence of any regulation of AI in the field investment arbitration, identified principles which must underlie such regulation, and discussed the potential impact of the European Union's AI Act on investment arbitration.
